The petitioner apprehends his arrest in connection with Majorganj P.S. Case No. 283 of 2017 registered under Section 420/34 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

The accusation is that Block Supply Officer of Block Majorganj received information about the selling of wheat and rice in black market by Badri Sah, P.D.S. dealer. On inquiry, 33 bags each containing 50 K.G. wheat were found at the house of the petitioner and garage of Ram Snehi Sah. Submission is that in course of investigation, it was found that 18 bags each containing 50 K.G. of wheat were not

Patna High Court Cr.Misc. No.29269 of 2018(2) dt.14-05-2018 2/2 of fair price shop rather the said wheat was purchased from the market. Further submission is that co-accused, Ram Snehi Sah, from whose garage 15 bags of wheat were recovered, has already been granted privilege of pre-arrest bail by a Bench of this Court vide order dated 30.04.2018 passed in Criminal Misc. No. 24067 of 2018.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sitamarhi, in connection with Majorganj P.S. Case No. 283 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
