JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have caught on the spot and near about 350 liters Mahua liquor are said to have been recovered from two bicycles, which were being carried by the petitioner and other accused but submission on behalf of the petitioner is that he was caught by the police on mere suspicion and the said recovery has not been made from his conscious possession. It is also pointed out on behalf of the petitioner that the petitioner is languishing in jail custody since 03-08-2015 and he does not have any criminal antecedent.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner

Patna High Court Cr.Misc. No.3360 of 2016 (2) dt.03-02-2016 2/2 named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Koilwar P.S.
