JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2018 Petitioners apprehend their arrest in connection with Makhdumpur P.S.Case No. 287 of 2017 registered for the offences punishable under Sections 341, 323, 379 and 384/34 of the Indian Penal Code.
Allegation against the petitioners is that they have demanded Rs.10,000/- as extortion from the informant, who is a bus driver and thereafter they have snatched gold chain and Rs.4500/- from him.
Submission of learned counsel for the petitioners is that story of demanding extortion has not been found true by police and police recommended for submission of charge sheet under Sections 341, 323 and 504/34 IPC.
Heard learned APP also and from perusal of the
Patna High Court Cr.Misc. No.32212 of 2018 (2) dt.29-06-2018 2/2 impugned order it appears that the court below had directed the petitioners to surrender and pray for regular bail as police recommended filing of charge sheet under bailable sections. Having heard both sides and in view of the facts and circumstances, this application is disposed of with a direction to the petitioners to surrender before the court below and pray for regular bail and learned court below on the basis of submission, as stated above, will dispose of the same by passing appropriate order, if possible, on the same day.
