JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 02-07-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Alauli P.S. Case No. 294 of 2017 registered under Sections 147, 149 and 302 of the Indian Penal Code.

According to the first information report, it was one Ram Kalin Yadav who is alleged to have assaulted with a brick on the head of the mother of the informant as a result of which she died.

It is submitted that since the petitioner is an young

Patna High Court Cr.Misc. No.35920 of 2018 (2) dt.02-07-2018 unmarried lady and had not participated in any manner in the offence alleged. However, her name has been given merely because she happens to be the family member of the other coaccused persons. Learned counsel for the State opposed the prayer for grant of pre-arrest bail to the petitioner.

Considering the vague and general allegation made against the petitioner and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, she is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Khagaria in connection with Alauli P.S. Case No. 294 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
