The petitioner seeks bail in anticipation of his arrest in connection with Deepnagar P.S. Case No. 07 of 2019 dated 02.01.2019 instituted for the offences under Sections 147, 148, 149, 342, 323, 427, 354(B), 307 and 302 of the Indian Penal Code.

Several persons have been named in the FIR. It has been alleged that about 300-400 persons came to the house of the informant and misbehaved with his daughter and assaulted the members of the family. The crowd was being led by three persons viz. Bimal Paswan, Nagina Paswan and Vicky Paswan. Though the petitioner is named in the FIR, but there is no specific accusation against him. It has further been alleged that the petitioner is a student and he was not even present in the town when the occurrence is said to have taken

Learned counsel for the petitioner submits that the implication of the petitioner is on the basis of information provided by someone who had definite axe to grind against him as even his parentage has wrongly been stated in the FIR. One of the accused persons, similarly situated has been granted anticipatory bail by a bench of this Court on 17.07.2019 passed in Cr. Misc. No. 27933 of 2019.

Apart from this, it has been submitted that the petitioner has got clean antecedents.

For the aforestated reasons, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Deepnagar P.S. Case No. 07 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
