ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 10.06.2015 in connection with a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has no concern with the occurrence in question. He further submits that though the alleged date of occurrence is 03.06.2015, the First Information Report in connection with present case was registered only on 07.06.2015 which is four days after the date of occurrence for which no plausible explanation was given by the informant. It is submitted that the petitioner is a poor person and sells cloths door to door and has been arrested on mere suspicion.

No.3742 of 2016 (2) dt.09-02-2016 P2/2 Considering the aforementioned facts and circumstances and that the petitioner has been in custody for more than six months and has no criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S.
