ANJANA MISHRA ORAL ORDER 19-07-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Amarpur (Fullidumar) P.S. Case No. 391 of 2016 for the offences registered under Sections 166A, 409/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the only allegation against the petitioner is that he, as a Panchayat Secretary has not handed over the documents with regard to the appointment of Panchayat Teachers as per the directions given to him. He further submits that actually, the said documents have been handed over presently and in support thereof he has produced Annexure- 2 series.

Considering the aforesaid facts and circumstances of the

Patna High Court Cr.Misc. No.27756 of 2017 (2) dt.19-07-2017 case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur (Fullidumr) P.S. Case No. 391 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
