The petitioner has preferred this application for grant of regular bail in a case registered under section 394 of the Indian Penal Code.

As per the prosecution case, the three accused persons wearing helmets on three motorcycles are said to have robbed the informant of his Hero Honda Splendor Plus motorcycle registered in the name of Vikash Kumar Jaiswal. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against three unknown. Referring to the order of the learned trial court, it is submitted that the petitioner has been implicated on the basis of his own confessional statement made before police. No incriminating article has been recovered as a result of the said confessional

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner being in custody for 7 months and no incriminating article having been recovered either from the possession of the petitioner nor as a result of his alleged confessional statement, the Court directs the petitioner to be enlarged on bail in connection with Mufassil P.S. Case no.232 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad.
