This application for anticipatory bail arises out of Bishanpur P.S. Case N0. 36 of 2019, disclosing offences under Sections 147,148,149,323,341,324,307,504 and 506 of the Indian Penal Code.

It is alleged against eleven named accused persons including this petitioner that they started assaulting the informant after having abused him. It is alleged against the petitioner that he assaulted the informant with an iron rod on his head. The injury report has been brought on record by way of Annexure-2 to this application to submit that the injury has been found to be simple in nature. Learned counsel for the petitioner has further submitted that prior to lodging of the present case,

Patna High Court CR. MISC. No.50840 of 2019(2) dt.16-08-2019 2/2 Bishanpur P.S. Case No. 35 of 2019 was registered on the same day with respect to the same occurrence and the present case is counter blast to the case earlier lodged by Rani Kumari.

Considering the nature of injury reported in the injury report, this application is allowed.

Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VIII, In Bishanpur P.S. Case No. 36 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
