The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 306 of the Indian Penal Code and Section 67 of the I.T Act, 2000.

It is alleged against the petitioner that he posted obscene pictures of the daughter of the informant on internet and when she told the petitioner about posting of her pictures on internet, he abused her and

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The petitioner has no concern with the deceased or posting of her pictures. The alleged mobile through which pictures were posted does not belong to the petitioner.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that witnesses in para 2, 9, 10, 11, 36 and 37 have supported the prosecution case. The postmortem report also suggests the cause of death due to asphyxia as a result of hanging. Considering the fact that there is direct allegation against the petitioner and the witnesses have also supported the prosecution case and the medical opinion also corroborates the prosecution version, this Court is not inclined to grant privilege of anticipatory bail
