JUSTICE ARUN KUMAR ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Section 379 of the Indian Penal Code. Allegation in brief is that theft of motorcycle was committed later on police recovered motorcycle from one Ranjan Yadav and also disclosed the complicity of this petitioner in the said occurrence.

Learned counsel appearing on behalf of the petitioner submits that except disclosure of the name of the petitioner by coaccused, there is no material against him. However, the case is at the investigation stage and the petitioner has got criminal antecedent of similar nature, so the prayer for anticipatory bail of the petitioner, namely, Deepak

Patna High Court Cr.Misc. No.28794 of 2017 (2) dt.13-07-2017 2/2 Kumar in connection with Samastipur Muffasil P.S. case No.253 of 2016 arising out of G.R. No.2293 of 2016 pending in the court of S.D.J.M., Samastipur is rejected. However, if he surrenders and seeks regular bail the same shall be considered on its own merit without being prejudiced by this order.
