JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-09-2024 Though the present petition has been filed for restoration of a petition bearing MJC No. 5404 of 2019, which has stood dismissed for default on account of non-compliance of the peremptory order dated 11.01.2024, however, the learned counsel for the petitioner submits that on account of inadvertence the defects could not be removed, nonetheless, he undertakes to remove the defects within a period of four weeks from today, hence, it is prayed that some compassion be shown and the aforesaid petition be restored to its original file.

Having regard to the facts and circumstances of the case and considering the submissions made by the petitioner, I deem it fit and proper to direct for restoration of the aforesaid petition bearing MJC No. 5404 of 2019 to its original file, subject to removal of the defects by the petitioner, within a period of four weeks from today.

The petition stands disposed off on the aforesaid terms.
