ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 25.07.2015 in connection with Barhara P.S. Case No. 184 of 2015, registered for offences punishable under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submitted that petitioner is not named in the FIR and as his name has been brought subsequently only on the basis of fact that near the dead body of the deceased, his mobile was also recovered and from the said mobile it appears that the petitioner had connected with the deceased shortly prior to the time of occurrence. Considering the aforementioned facts and circumstances and also that the petitioner is languishing in jail custody since 25.07.2015, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Nitesh Kumar, Judicial Magistrate 1st, Class, Purnea in connection with Barhara P.S. Case No. 184 of 2015.
