JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Jadiya P.S. Case No. 28 of 2018 dated 22.02.2018 instituted for the offences under Sections 414, 420, 467, 468, 471, 120(B), 34 of the Indian Penal Code. One Md. Shahid was arrested in connection with the offence regarding theft of a vehicle. The aforesaid Md. Shahid disclosed the name of the petitioner and at his instance, the vehicle was recovered. The vehicle allegedly has been recovered from near the wholesale shop for sale of bananas of the petitioner.
But for the confession of co-accused Md. Shahid and the recovery from a distant place/public place, there is no
Patna High Court Cr.Misc. No.32191 of 2018 (3) dt.29-06-2018 2/2 other material to connect the petitioner with the crime. The petitioner does not have any criminal antecedent. Considering the aforestated facts, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Vth, Supaul in connection with Jadiya P.S. Case No. 28 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Ashutosh Kumar, J) Shageer/- U T
