The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 447, 448, 323, 307, 379 of the Indian Penal Code and 27 of the Arms Act. The prosecution case in short is that the accused persons came to the residence of the informant and started committing loot and also assaulted the informant due to which he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.7.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that four

Patna High Court CR. MISC. No.50906 of 2019(2) dt.16-08-2019 2/2 persons including the petitioner are said to have assaulted the informant. General and omnibus allegation has been made against the petitioner. There is no specific overt act alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S. Case No. 619 of 2018.
