2. The petitioner apprehends arrest in connection with Darbhanga Town PS Case No.307 of 2023 dated 24.10.2023, instituted under Sections 307, 290, 341, 323, 324, 504, 506/34 of the Indian Penal Code giving rise to Sessions Trial No.243 of 2024.
3. The allegation against the petitioner is that he inflicted knife blow on the chest of informant. The reason behind the occurrence is sell and purchase of drugs etc.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Though there is specific allegation against the petitioner
Patna High Court CR. MISC. No.59894 of 2024(2) dt.23-08-2024 2/2 that he stabbed the informant with a knife over the left lateral part of lower chest, but the fact is that the petitioner has neither assaulted the informant nor stabbed him. The informant sustained the alleged injury somewhere accidentally but he has implicated the petitioner because of personal grudge. Further submission is that the petitioner is in custody since 03.01.2024. The trial has started and the petitioner will fully cooperate in trial.
5. Learned APP has opposed the prayer for bail.
6. There is direct allegation against the petitioner that he inflicted knife blow on the chest of the informant which has been supported by the injury report which has been annexed as Annexure-2.
7. In such view of the matter, I am not inclined to enlarge the petitioner on bail at this stage.
8. Accordingly, prayer of the petitioner for grant of bail is rejected for the present.
9. The application stands dismissed.
