The petitioner seeks bail in Kotwali P.S. Case No. 62 of 2017 registered under Sections 341, 323, 384, 354A, 504, 506 and 34 of the Indian Penal Code.

The petitioner is said to have tried to snatch the mobile and money of the informant by putting his hand inside her blouse.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. As a matter of fact, there was altercation between the informant and the co-accused Botal Yadav over payment of dues amount of milk and the petitioner had tried to pacify the matter, for which the petitioner has been falsely implicated in this case.

Though as per the prosecution case, the petitioner has put his hand inside the blouse of the informant, but there was no intention to outrage her modesty rather of snatching money and mobile phone of the informant which she had put in her blouse. The petitioner has been languishing in custody since 21.03.2017. Co-accused Botal Yadav has been enlarged on bail by learned lower court. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Kotwali P.S. Case No. 62 of 2017.
