JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 09-02-2015 Heard Mr. Rashid Izhar learned counsel for the petitioner and AC to AAG-9 for the State.

Learned counsel for the petitioner submits that the order of the Collector/Additional Collector can be challenged before and entertained by the Tribunal. The petitioner approached the wrong forum as found in the impugned order by the respondent-Divisional Commissioner.

He, therefore, seeks permission of the Court to withdraw this writ application in order to assail the order of the Collector/Additional Collector before the Tribunal after seeking condonation of delay.

Having heard the parties, the writ application is permitted to be withdrawn with the liberty aforesaid. If any such application for condonation of delay is filed along with the

Patna High Court CWJC No.2451 of 2015 (2) dt.09-02-2015 3/3 application before the Tribunal, I am sure the Tribunal will consider the fact that the petitioner had been pursuing his remedy before the wrong forum.
