The petitioner is not named in the first information report but in course of investigation the name of the petitioner surfaced in the confessional statement of the co-accused Neyaz Dewan, who has already been granted bail by this Court. Moreover, in the present case nothing has been recovered from the conscious possession of the petitioner and except the criminal antecedent as well as confessional statement there is nothing against him. Accordingly, let the petitioner Amzad Ali be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Bagaha P.S. No. 330/2014.
