The petitioner seeks bail in Kotwali P.S. Case No. 751/2014 registered under Sections 341,498A, 307, 34 of the Indian Penal Code. Later on, Section 304B IPC was added. The deceased in her Fardbeyan before the Executive Magistrate, Bhagalpur stated that the petitioner and others assaulted her and poured Kerosene Oil on her and her husband ignited fire. It is submitted that the petitioner is the mother-in-law of the deceased and she has falsely been implicated in the case. Co-accused Bharat Raj, Nandu Rajak (father-in-law of the deceased), Mamta Devi and Pankaj Rajak have already been released on bail by different benches of this Court vide orders passed in Cr. Misc. Nos. 48546/2015, 46160/2015, 25814/2015, 50537/2014. The petitioner is mother-in-law of the deceased and
Patna High Court Cr.Misc. No.4875 of 2016 (2) dt.13-07-2016 2/2 her case stands on the same footing. The petitioner is in jail since 18.10.2014.
Considering the facts aforesaid and the fact that the petitioner is in jail for more than one and half years and similarly situated co-accused have already been released on bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bhagalpur in Kotwali P.S. Case No. 751 of 2014 corresponding to S.T. No. 384/15.
