The petitioners apprehend their arrest in Runnisaidpur P.S. Case No.18/2016 registered under Sections 307 and other minor Sections of the Indian Penal Code.
The informant alleged that the petitioners Randhir Singh, Ranjit Singh, Vikram Kumar and Prabhakar Kumar along with 2-3 unknown persons having armed with different weapons came and started searching Munna Kumar. When the son of the informant could not be found in the house, all the accused persons assaulted the informant on his head. The informant got head injury.
Learned counsel for the petitioners submits that four persons are alleged to have assaulted the informant but the informant got one injury on his head, which is simple in nature.
Patna High Court Cr.Misc. No.29531 of 2018 (2) dt.18-05-2018 2/2 The injury is said to have been caused by sharp edged weapon but the petitioners are alleged to have armed with hard and blunt object. Similarly situated co-accused Prabhakar Kumar has already been granted anticipatory bail vide order dated 17.01.2018 passed in Cr. Misc. No.1702 of 2018. The case of the petitioner stands on same footing.
Taking into consideration the fact that four persons including three petitioners, who are alleged to have assaulted the informant but only one injury that too simple in nature on the head of the injured was found and one of the accused namely Prabhakar Kumar has already been granted anticipatory bail, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi, in connection with Runnisaidpur P.S. Case No.18 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Amit/- U T
