The petitioner seeks pre-arrest bail in connection with Jamui P.S. Case No.341 of 2017 registered under Sections 147, 148, 149, 307, 353A, 295A, 298 and 120B of the Indian Penal Code and Section 27 of the Arms Act.
Regard being had to the fact that though the alleged occurrence of offence took place on 02.10.2017, the first information report was registered after six days on 08.10.2017 and in the first information report no overt act is alleged against the petitioner, who is said to be a man of clean antecedent and another co-accused Md. Saquib Jafar Mallick @ Md.Saquib Jafar @
Patna High Court Cr.Misc. No.29587 of 2018 (2) dt.17-05-2018 2/2 Munna @ Munnu Mian having identical allegation has already been granted pre-arrest bail vide order dated 06.04.2018 passed by a Bench of this Court in Cr. Misc. No.61983 of 2017, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No.341 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
