JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-02-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Barh P.S. Case No. 44 of 2012 instituted for the offence under Section(s) 302/34 of Indian Penal Code and Section 27 of the Arms Act pending in the court of learned Additional Chief Judicial Magistrate, Barh. As per the FIR, petitioner caused fire arms injury in the Kanpatti of the deceased.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case because of land dispute between the parties. Police after investigation has found the case to be incorrect against the petitioner and submitted charge sheet only against co-accused Bijali Sao and petitioner was not sent up for trial. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 1, Barh in Barh Police Station Case No. 44 of 2012.
