The petitioner apprehends his arrest in Shakurabad P.S. Case No.1 of 2019 registered under Section 307 and other minor Sections of the Indian Penal Code.
The informant named altogether four persons and alleged that he saw all the accused persons were assaulting the son of the informant(Nagendra Bind) and his son was lying on the ground but during the course of pacifying the matter, the informant and his wife were also assaulted.
The learned counsel for the petitioner submits that there is a counter version being Shakurabad P.S. Case No.2 of 2019. The injury report shows that informant, Kameshwar Bind got one lacerated wound and another swelling. Both the injuries are simple in nature. Nagendra Bind also got one lacerated
Patna High Court CR. MISC. No.52073 of 2019(2) dt.21-08-2019 2/2 wound on left parital region and Sakuntala Devi(wife of the informant) also got simple injury.
Taking into consideration the fact that petitioner is agnate of the informant and there is a case and counter case and the fact that on account of assault made by the petitioner, the informant and others got simple injuries, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Shakurabad P.S. Case No.1 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
