=========================================================== CORAM: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 21-07-2015 Respondent is the wife and that too a legally wedded wife. There are three children, who are born out of the wedlock. If the court below of Principal Judge, East Champaran, Motihari has granted maintenance at the rate of Rs.3200/- per month looking at the cost of living and the inflation, the minimum of such a direction has been issued. In fact, the Court was inclined to enhance the amount so fixed. However, on an earnest request made by the counsel for the petitioner with a clear understanding that this amount will be paid as well as arrears will also be paid, the Court does not enhance the amount of maintenance. So long as the marriage does not get annulled the obligation to pay the maintenance remains upon the shoulder of the present petitioner.
Patna High Court CWJC No.18374 of 2010 dt.21-07-2015 2/2 Writ application has not merit. It is dismissed. (Ajay Kumar Tripathi, J) sk U
