For the Petitioner/s : Mr. Saroj Kumar, Advocate For the Respondent/s : Mr. Anil Kumar, G.P.-23 ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-08-2015 The petitioner's husband, her one son and two nephews have been made accused in Ladaniya P.S. Case No.17 of 2014 dated 12.2.2014 registered under sections 363 and 366 of the Indian Penal Code.
By filing the present criminal writ petition, the petitioner seeks a direction to be issued to respondent-authorities to get investigation of the case done by Criminal Investigation Department of the State or any other independent investigating agency.
Patna High Court Cr. WJC No.102 of 2015 (2) dt.13-08-2015 2/2 In my view, the application is misconceived. The petitioner has got no locus standi in the matter. She is neither an accused nor informant in the case. Even otherwise, an accused of a case cannot choose the agency which would investigate his case. In that view of the matter, I find no merit in this application. Accordingly, the application is dismissed. (Ashwani Kumar Singh, J) Md.S./- U T
