JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2017 The petitioner seeks regular bail in connection with Giriyak P.S. Case No. 118 of 2017, registered for offences punishable under Sections 363 and 365 of the Indian Penal Code. Allegation against the petitioner that she along with other co-accused person of this case kidnapped the daughter of the informant.

It has been submitted on behalf of the petitioner that petitioner has no role to play in the kidnapping of daughter of the informant and she has falsely been implicated in this case and is patidar of the informant. Further petitioner has been in judicial custody since 22.04.2017.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, in view of the fact that from

Patna High Court Cr.Misc. No.32506 of 2017 (3) dt.25-07-2017 2/2 perusal of the impugned order, it appears that the girl in her statement recorded under Section 164 Cr.P.C has named this petitioner that she forcibly took her to bolero vehicle of other coaccused and, thereafter, she was recovered from the house of other co-accused person, as such, I am not inclined to release the petitioner on bail, her application for regular bail is accordingly rejected.

However, since the petitioner is a lady, trial court is directed to expedite the trial and try to conclude it within a period of nine months.
