The petitioner seeks pre-arrest bail in connection with Madanpur P.S. Case No.45 of 2018 registered for the offences under Sections 4(1), 4(I-A) MMCR & 26(A)/27/40 of BMMCR and 40 of the Act.

Accusation is that petitioner, who is running the Brick kiln in the name and style of 'Raja Int' has not deposited the ownership fee for the year 2015-2016.

Learned counsel appearing on behalf of the petitioner submits that, while the petitioner has deposited aforesaid fee, but without issuing any notice, the present case has been lodged. Moreover, if the aforesaid fee has not been deposited, he is still

Patna High Court Cr.Misc. No.32249 of 2018 (2) dt.14-06-2018 2/2 ready to deposit the same. Petitioner has got no criminal antecedent.

Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of arrest or surrender before the learned Court below within six weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in Madanpur P.S. Case No. 45 of 2018 subject to the condition as laid down under Section 438(2) Cr.P.C.
