JUSTICE SHIVAJI PANDEY ORAL ORDER 08-04-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner has raised a grievance that the order dated 31.07.2014 has been passed in C.W.J.C. No. 7888 of 2013, but the complain has been made that while making a purported compliance of the order dated 31.07.2014, in fact, respondents have flouted the order itself, which is not permissible

Patna High Court MJC No.259 of 2015 (4) dt.08-04-2017 2/2 in law, as this Court in a specific term, has directed to dispose of the matter in terms of the Circular dated 26.12.2012 and the order passed by the Hon'ble Apex Court in the case of Vishwanath Pandey vs. State of Bihar, reported in 2013 (3) PLJR (SC) 305 whereas learned counsel for the State submits that the order of this Court has been complied with. The issue whether the order has been complied in terms of the aforesaid direction, requires a deep consideration of the fact, cannot be adjudicated in the present proceeding.

If the petitioner feels aggrieved with the order passed against him, he will be at liberty to challenge the same in the appropriate proceeding.

Accordingly, this petition is disposed of.
