JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-08-2015 The present application has been filed for modification of the order dated 29.09.2010 passed in Cr. Misc. No. 35982 of 2010 to the extent that petitioner denies the factum of marriage with the informant. The petitioner was granted bail in a case registered for the offences punishable under Sections 321, 323, 328, 342, 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. It appears from the order dated 29.09.2010 passed in Cr. Misc. No.

35982 of 2010 that petitioner admitted the marriage and it was submitted that since there was no issue from the first wife, hence after disclosing factum of the first marriage the petitioner married with the informant. The petitioner agreed to make payment of Rs. 1000/- per month to the informant from October, 2010 to the informant. Considering the fact that on the submission of learned counsel for the petitioner the earlier order was passed and for the modification of the order dated 29.09.

Patna High Court Cr.Misc. No.41696 of 2014 (2) dt.19-08-2015 2/2 the present modification application was filed on 08.10.2014, this Court is not inclined to modify the earlier order. Accordingly the modification application is disposed of in connection with Tikari P.S. Case No. 175 of 2006, pending in the Court of learned Chief Judicial Magistrate, Gaya.
