The petitioner seeks bail in connection with Guraru P.S. Case No.17 of 2017 registered under Section 377 of the Indian Penal Code.

The accusation against the petitioner is of committing unnatural offence with Prince Kumar, aged about 10 years, the son of the informant Mukesh Ram, Learned counsel appearing on behalf of the petitioner submits that no injury was found near the anal of the victim and in the medical examination of the victim, no alive or dead spermatozoa was found. In fact, the petitioner and the informant

Patna High Court Cr.Misc. No.18578 of 2017 (3) dt.21-06-2017 2/2 are next door neighbours and due to village politics, the petitioner has falsely been implicated in this case. Further submission is that the petitioner having no criminal antecedent is in custody since 07.02.2017 and on investigation, the police has already submitted chargesheet against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge-cum-Special Judge, POCSO Act, Gaya, in connection with Guraru P.S. Case No.17 of 2017/POCSO Case No.27 of 2017.
