2. This is the third attempt of the petitioner for grant of regular bail in connection with S.Tr. No. 206 of 2024 arising out of Katoriya P.S. Case No. 97 of 2022 registered for the offence under Sections 304(B), 328/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner, being the husband of the deceased is said to have killed the deceased.

4. The petitioner is in custody since 15.03.2023.

5. From the impugned order, it appears that in the trial, only two witnesses have been examined.

6. Considering period of custody of the petitioner

Patna High Court CR. MISC. No.55754 of 2025(2) dt.19-09-2025 2/2 and the delay in the trial, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-I, Banka/concerned Court below in connection with S.Tr. No. 206 of 2024 arising out of Katoriya P.S. Case No. 97 of 2022.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
