The petitioner prays for grant of anticipatory bail in a case registered for the offence punishable under sections 363, 366A and 376 of the Indian Penal Code.

As per allegation, this petitioner and other co-caused kidnapped daughter of the informant.

It is submitted on behalf of petitioner that the police after investigation submitted final form showing the petitioner innocent but the court below took cognizance against the petitioner. Petitioner claims clean antecedent and co-accused have been granted anticipatory bail.

Learned counsel for the State opposes the prayer for anticipatory bail.

Chief Judicial Magistrate VI, West Champaran, Bettiah in Yogapatti P. S. Case no. 177 of 2002 subject to condition as laid down under section 438(2) Cr.P.C.
