JUSTICE ARUN KUMAR ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Kotwali (Barari) P.S. Case No.637 of 2016 registered under Sections 395 of the Indian Penal Code.
Allegation in brief is that 10-12 unknown criminals looted batteries from the workshop of Bihar State Road Transport Corporation.
Learned counsel appearing on behalf of the petitioner submits that F.I.R. is against unknown and except the confessional statement made by the petitioner, there is no material against the petitioner. Neither he has been put on T.I.P. nor any incriminating looted material has been recovered leading to his confession. Moreover, charge sheet too has been submitted in this
Patna High Court Cr.Misc. No.22390 of 2017 (2) dt.12-06-2017 2/2 case and he has been in custody since 13.1.2017 and other similarly situated other co-accused have been granted bail by a Co-ordinate Bench of this Court.
Having considered the said facts and circumstances, the petitioner, namely, Pankaj Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Kotwali (Barari) P.S. Case No.637 of 2016.
