JUSTICE ARUN KUMAR ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Baheri P.S. Case No.17 of 2017 registered under Sections 420, 275, 276 of the Indian Penal Code and 27(b)(ii)/28/22(3)/30/36(AC) Drugs & Cosmetic Act, 1940.

Allegation in brief is that police, on information, raided the house of the informant and recovered medicines kept in cartoons and Almiras and also prepared seizure list. Learned counsel appearing on behalf of the petitioner submits that this case was lodged on the information given to the police by own brother of the petitioner and the house whereupon seized articles were recovered was in joint possession. Moreover, copy of the seizure list was not handed over to the petitioner and

Patna High Court Cr.Misc. No.22396 of 2017 (2) dt.12-06-2017 2/2 other family members and he has been in custody in this case since 21.3.2017 moreover charge sheet has been submitted in this case.

Having considered the said facts and circumstances, the petitioner, namely, Bipin Kumar Jha is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M-IX, Darbhanga in connection with Baheri P.S. Case No.17 of 2017.
