JUSTICE ARUN KUMAR ORAL ORDER 12-06-2017 Heard learned counsel for the petitioners and learned APP appearing on behalf of the State. Petitioners, already in custody, seek bail in connection with Sahebganj P.S. Case No.77 of 2017, registered under Sectiond 328 and 379/34 of the Indian Penal Code. Allegation in brief is that these petitioners asked the informant to take away some passengers from his vehicle. The passengers sat on the vehicle of the informant and after reaching some destination of 2 kms. away, injected some medicine and made him unconscious and taken away his vehicle. It is alleged that these petitioners in conspiracy with accused persons had committed the crime.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.22715 of 2017 (2) dt.12-06-2017 2 / 2 petitioners submits that the petitioners are also taxi owners. They only asked the informant to take some passengers in his vehicle and there is no allegation that the petitioners are involved in making the informant unconscious and taking away his vehicle, those passengers have committed this offence and these petitioners have got no criminal antecedent. The petitioners have been in custody in this case since 25.03.2017 and the vehicle of the informant was abandoned and recovered from road side. Having considered the said facts and circumstances, petitioners, namely, Md. Shamshad @ Chunnu and Md. Mahmood are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Sahebganj P.S.
