JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Chapra Muffasil P.S. Case No. 399 of 2017 dated 12.12.2017 instituted for the offences under Sections 341, 323, 307, 353, 147, 148, 149, 504, 506 of the Indian Penal Code.
The petitioner is though named in the F.I.R but nothing specific has been alleged against him. The allegation is that because of the difficulties in getting the sand for the construction purposes, a blockade was put up and when the Police tried to intervene/pacify the protesters, they were assaulted.
The learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.32152 of 2018 (4) dt.29-06-2018 2/2 that his name has been supplied to the Police by some persons who are holding grudge against him. On the date and time of occurrence, the petitioner was suffering from stomach trouble and he has unnecessarily been made accused in this case.
The petitioner does not have any criminal antecedent. Considering the aforestated facts, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 399 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Ashutosh Kumar, J) Shageer/- U T
