The petitioner seeks bail in a case instituted for the offences under Sections 395 and 397 of the Indian Penal Code.

As per the First Information Report two persons have entered into the house of the informant and when they have not received the rifle, they mercilessly assaulted the inmates of the house.

Learned counsel for the petitioner submits that petitioner was never communicated about the pendency of the present case and he was arrested from his house. He further submits that in the First Information Report age of the

Patna High Court Cr.Misc. No.6459 of 2016 (2) dt.01-03-2016 miscreants have been shown 22-23 years. If that will be taken into consideration the petitioner cannot be said to be involved in the present case.

Petitioner is aged about 65 years which is apparent from order sheet.

Having considered the facts and circumstances of the case, let petitioner, Bino Dharhi, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura in Sheikhpura P.S. Case No. 33 of 2003.
