The petitioner seeks regular bail in connection with Tariyani PS case no. 29 of 2017 registered for the offences punishable under Sections 25(1-b)a, 26, 35 of Arms Act. The case of the prosecution is that two criminals were apprehended who disclosed that they had kept the carbine being used for committing crime with one Sanjay Kumar, the petitioner herein, whereupon, the police is said to have apprehended the petitioner and during interrogation, it transpired that he had given the carbine to one Sanjay Sah and thereafter, upon apprehending and searching Sanjay Sah, the said carbine is said to have been recovered.

Patna High Court Cr.Misc. No.29110 of 2017 (2) dt.01-07-2017 2/2 Learned counsel for the petitioner submits that recovery has not been made from the petitioner and the allegations leveled in the FIR does not constitute any offence against the petitioner. It is further submitted that so far as antecedent of the present petitioner is concerned, he has been acquitted in one case and in another case, he is on bail and he is in custody in the present case since 06.03.2017.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Sheohar in connection with Tariyani PS case no. 29 of 2017.
