JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2017 The petitioner seeks regular bail in connection with Complaint Case No. 1780 of 2014, registered for offences punishable under Sections 498(A), 406 and 504 of the Indian Penal Code.
This case was earlier sent to mediation committee for one time settlement between the parties vide order dated 19.07.2017 and during the said period, petitioner was allowed the privilege or provisional bail.
It has been submitted by learned counsel for the petitioner that petitioner is ready to pay Rs. 2.5 lakhs to complainant/opposite party no. 2, however, the complainant is
Patna High Court Cr.Misc. No.29678 of 2017 (4) dt.06-11-2017 demanding more and so far merit of the case is concerned, he is ready to cooperate and has not misused the privilege of provisional bail.
Heard learned A.P.P. also as well as learned counsel for the complainant.
Having heard both sides, in view of the above facts and circumstances of the case, let petitioner deposit the bank draft of Rs. 2.5 lakhs drawn in favour of complainant before the court below and the court below after verifying the same, shall confirm the provisional bail of the petitioner.
It is open to the court below to release the said amount of Rs. 2.5 lakhs in favour of the complainant and the same shall be deducted from any amount if final settlement is reached between the parties.
