The petitioner prays for grant of anticipatory bail in a case registered for the offence punishable under sections 307, 379 and other allied sections of the Indian Penal Code. As per allegation, this petitioner is alleged to have assaulted brother of the informant by means of sword. It is submitted on behalf of petitioner that there is land dispute between the parties and there is no repetition of blow. There is no specific allegation of theft against this petitioner and nothing has been recovered from his possession. Petitioner claims clean antecedent.

Learned counsel for the State opposes the prayer for

Considering the facts and circumstances of the case, in the event of arrest/ surrender within four weeks from today, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Katihar (Nagar) P.
