JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code, Section 47(a) of the Excise Act and Section 103 of the Trade Mark Act.

The prosecution case is that on information that the petitioner is indulging in manufacturing illicit liquor, the raid was laid and from the house of the petitioner, foreign liquor along with duplicate bottles and caps of foreign liquor were recovered. It is submitted by learned counsel for the petitioner that recovery has been made from the joint family house and only on suspicion, the accusation has been levelled.

Considering the nature of accusation, this Court is not

Patna High Court Cr.Misc. No.6797 of 2016 (2) dt.15-02-2016 2/2 inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Rajapakar (Barati O.P.) P.S. Case No. 138 of 2015 pending in the court of learned CJM, Vaishali at Hajipur.

Accordingly, the application is disposed of.
