2. The petitioner apprehends arrest in connection with Barbigha (Keuti O.P.) P.S. Case No. 459 of 2022 dated 22.10.2022 instituted under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
3. As per the prosecution case, total 261 litres of foreign liquor was seized near the palm tree.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to two criminal antecedents. There is no recovery from the conscious possession of the petitioner. Learned counsel further submits that similarly situated co-accused
Patna High Court CR. MISC. No.57694 of 2023(2) dt.04-09-2023 2/2 namely, Kanhiya Kumar, has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 15.05.2023 in Cr. Misc. No. 19182 of 2023.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge, Sheikhpura in Barbigha (Keuti O.P.)
