JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 03.12.2015 in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code. The accusation against the petitioner is that he along with several other persons confined a teacher in a school and when informant and other officials went to rescue the aforesaid teacher, petitioner and his associates attacked on the informant and other officials and also damaged the vehicles.

Contention on behalf of the petitioner is that one Bouka Rishi, son of late Sadanand Rishi is named in the first information report but police caught the petitioner, whose father's

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Mansahi P.S. Case No. 67 of 2015.
