JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 24.04.2015 passed in Cr. Misc. No. 4762 of 2015 but this petition has been filed on behalf of the petitioner on the ground that petitioner is in jail custody since 27.05.2014 but up till now, not a single prosecution witness could be examined in this case.

The trial court has reported vide letter no. 39 dated 05.05.2016 that charge against the petitioner was framed on 18.08.2015 but in spite of issuance of summons and other process, the prosecution failed to produce any witness. Considering the stage of the trial as well as
