====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-06-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Sahebpur Kamal P.S. Case No.265 of 2017 registered under Sections 341, 307 and 504/34 of the Indian Penal Code. The accusation is that four persons, named in the F.I.R., including the petitioner reached at the house of the informant and started to abuse. When the informant made protest, this petitioner gave the iron rod blow, causing blood oozing injury on his head, while the others caused injury to the informant through fists and slaps. The cause of occurrence is that this petitioner had taken the bricks from the father-in-law of
Patna High Court Cr.Misc. No.30089 of 2018(2) dt.11-06-2018 2/2 the informant with an assurance to return the same but in spite of several requests, the petitioner did nor return the bricks. Learned counsel for the petitioner submits that the petitioner is the brother-in-law of the informant and due to minor dispute, the informant has lodged this false case. Moreover, the dispute has been settled in between the petitioner and the informant, which is detailed in paragraph-52 of the case diary.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Begusarai, in connection with Sahebpur Kamal P.S. Case No.265 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
