The petitioner is accused in connection with Akbarpur P.S. Case No. 210 of 2015, registered under Section 302/34 of the Indian Penal Code.

The prosecution case is that on 20.08.2015, the father of the informant went to keep vigil at his field. After half hour, villager of the informant, namely, Altaf Ansari informed that dead body of father of the informant is lying near the house of Md. Mansoor Ansari (Petitioner). The informant further disclosed that some unknown person caused injuries to his father in which he died.

No.9763 of 2016 (3) dt.02-05-2016 2/2 petitioner submits that it would appear from the F.I.R. that petitioner is not named in the F.I.R. and petitioner and informant are co-villagers and next door neighbour. In the case diary witnesses have disclosed that this petitioner throw the piece of brick over the deceased from his roof, which hit the head of the deceased, except the suspicion there nothing on the record to show involvement of the petitioner in the preset case. The petitioner is in custody since 24.08.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-II, Nawada in connection with Akabarpur P.S. Case No. 210 of 2015.
