The petitioner seeks bail in connection with Parasbigha P.S. Case No.132 of 2016 registered under Section 395 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner surfaced in this case in the confessional statement of the co-accused Anil Kumar Singh, Bindu Kumar alias Bauna and Dinesh Kumar alias Bhura, as detailed in paragraphs-13, 41 and 43 of the case diary. Except that, no material has been collected by the Investigating Officer during

Patna High Court Cr.Misc. No.27895 of 2017 (3) dt.23-06-2017 2/2 the investigation against the petitioner. While the informant has detailed about the physique of the culprits in the F.I.R. but the petitioner has not been put on T.I. Parade. The petitioner is in custody since 06.02.2017. While the petitioner is accused in two other cases, as detailed in paragraph-3 to this application, but in those cases, the petitioner is on bail.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Bharti, Judicial Magistrate, First Class, Jehanabad, in connection with Parasbigha P.S. Case No.132 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
