JUSTICE BIBEK CHAUDHURI ORAL ORDER 19-09-2024 By filing the instant writ petition, the petitioner has disputed his date of retirement. It is not in dispute that the petitioner was an employee of the South Bihar Power Distribution Company Limited. On 5th of August 2023, a notice was issued to the petitioner stating, inter alia, that in the official record, the date of birth of the petitioner is recorded as the 23rd of January 1967. Therefore, on completion of 60 years of age, the petitioner was scheduled to retire on superannuation on 31st of January 2024.

The petitioner directly came to this Court challenging the said order, stating, inter alia, that his date of birth is 22nd of February 1971, as per the certificate issued by Ramnath Sanskrit Prathmik Sah Ucch Vidyalaya, Sikthi, Bhabua (Rohtas), on 7th of August 1991. He got service on compassionate ground in the year 1998.

3. Since there is a discrepancy in the official record and the school leaving certificate as to the date of birth of the petitioner, the petitioner is at liberty to file a representation to the Respondent No. 6 within two weeks from the date of communication of this order.

4. The Respondent No. 6 is directed to transmit the application, if any, to be filed by the petitioner to the concerned authority for speaking and reasoned order within 30 days from the receipt of such representation.

5. The instant writ petition is thus, disposed of. (Bibek Chaudhuri, J) uttam/- U
