The petitioner seeks bail in connection with Parbatta, P.S. Case No. 283 of 2015 registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act. Allegedly, from possession of the petitioner one loaded country made pistol besides one other cartridge and mobile set were recovered.

Submission is of false implication and that the petitioner has been made victim of the circumstances, he is in custody since 14.09.2015 other co-accused Raja Sahni has already been allowed bail vide Criminal Misc. No.693 of 2016 by another co-ordinate Bench of this Court and as such the petitioner deserves

Patna High Court Cr.Misc. No.6106 of 2016 (2) dt.23-02-2016 2/2 sympathetic consideration to which learned A.P.P. opposes. In the facts and circumstance stated above, the petitioner shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned C.J.M, Khagaria, in connection with Parbatta P.S. Case No. 283 of 2015, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
